- Your public profile information, such as skills, work history, and certifications, which may be visible to other users.
- For Hiring Companies, we collect company details and contact information.
- Sensitive Personal Information:
- To verify identity and facilitate background checks, we may collect government-issued identification numbers, such as a driver's license number or Social Security Number (SSN).
- We collect tax forms (e.g., W-9) necessary for payment processing.
- This sensitive information is stored securely in an encrypted environment (such as Microsoft Key Vault or Azure).
- Geolocation Data:
- We collect your precise geolocation data through the mobile app when you are on a shift to verify check-in and check-out times. Hiring Companies may receive confirmation of worksite presence during the active shift window and up to thirty (30) minutes prior to a scheduled shift for attendance verification.
- If you opt-in, we use your device's location to send you notifications about nearby shift opportunities.
- Work and Payment Activity:
- We collect information about shifts you apply for, accept, and complete, as well as ratings you receive.
- While we do not store full payment information, we collect tax and bank details necessary to facilitate payments through our third-party payment vendor.
- Background Check Information: With your explicit consent, we will receive background check results from our third-party screening provider. These results may be stored securely and shared with Hiring Companies as you authorize. Gygler does not resell, repurpose, or use background screening reports for marketing or profiling. Reports are retained only as necessary for marketplace eligibility determinations and compliance with applicable law.
- Technical and Usage Data: We automatically collect your IP address, device information, browser type, and usage logs through cookies and other tracking technologies like Google Analytics and Meta (Facebook) Pixel.
- Communications: We collect information when you communicate with us for support or send messages to other users through the Platform.
- Biometric Information: In certain markets or for specific security features, we may collect and use biometric identifiers or biometric information (such as facial geometry templates or voiceprints) for identity verification, secure check-in, and fraud prevention. Our collection, use, storage, and destruction of biometric data is governed by our Biometric Information Policy, which is incorporated into this Privacy Policy by reference. Where required by law, we will obtain your written consent before collecting or using biometric data.
How We Use Your Information
We use your information for the following purposes:
- To Operate the Platform:
- To create and maintain your account, facilitate connections between Gyglers and Hiring Companies, and process payments.
- To verify your identity and facilitate background checks.
- To monitor your location during shifts for timekeeping and security, as described in our Worker Terms.
- To Improve Our Services:
- To analyze usage trends, conduct analytics, and improve the Platform's features and functionality.
- To develop new products and services.
- For Marketing and Communications:
- To send you administrative communications, such as updates to our terms or policies.
- To send you promotional emails or push notifications about new services, features, and opportunities. You can opt out of these communications at any time.
- For Legal and Security Purposes:
- To enforce our Terms of Service and prevent fraudulent or prohibited activity.
- To comply with good faith, properly served government warrants, subpoenas, court orders, or other legal obligations.
How We Share Information
We do not sell your personal information in exchange for monetary consideration. We may share your data in the following circumstances:
- With Other Platform Users:
- We share a Gygler's public profile, qualifications, and background check results (as permitted) with Hiring Companies to allow them to evaluate candidates for shifts. Hiring Companies cannot export this data from the platform.
- We share a Hiring Company's details with Gyglers so they can evaluate shift opportunities.
- With Third-Party Service Providers: We share information with vendors who perform services on our behalf, such as payment processors, background check providers, and analytics tools (e.g., Google Analytics). These providers are subject to confidentiality agreements.
- For Legal Reasons and Business Transfers: We may share information to comply with legal requests or in the event of a merger, acquisition, or sale of assets.
Cookies & Tracking
We use cookies, pixels (including tools such as the Meta Pixel), and similar technologies for analytics, performance measurement, fraud prevention, and marketing purposes, including interest-based or cross-context behavioral advertising. Certain advertising and analytics tools may collect information about your interactions with the Platform and may share limited technical identifiers (such as device identifiers, IP address, or browser characteristics) with third-party advertising partners. Under California law, this type of activity may be considered "sharing" personal information for cross-context behavioral advertising purposes.
Gygler does not sell personal information in exchange for monetary consideration. However, to the extent our use of advertising technologies is considered a "sale" or "sharing" under applicable California law, California residents have the right to opt out of such sale or sharing. You may exercise your right to opt out by:
- Adjusting your cookie preferences through our cookie settings tool (if available),
- Enabling browser-based privacy controls such as Global Privacy Control (GPC), or
- Contacting us at questions@gygler.com with the subject line "California Privacy Opt-Out."
Disabling cookies through your browser settings may affect certain features or functionality of the Platform. We do not knowingly sell or share the personal information of individuals under age 16.
Data Security
- We implement robust security measures to protect your information, including encryption for sensitive data, access controls, password policies, and multi-factor authentication. While no system is 100% secure, we take reasonable steps to protect your information.
Data Retention
We retain your personal information for as long as your account is active or as necessary to fulfill the purposes for which it was collected. Specific data types may be retained for different periods based on our legal and business needs:
- Account and Profile Data: Retained for as long as your account is active.
- Tax and Payment Records: Retained for up to seven (7) years to comply with financial and tax regulations.
- Safety and Integrity Data: If you are removed from the Platform for a violation of our terms or if you request to delete your account, we will delete your public profile; however, we will retain certain information, such as records of past complaints or terms of service violations, to maintain the safety and integrity of our platform and to prevent users who have been removed from re-registering.
- Biometric Data: Where collected, biometric data is retained and permanently destroyed in accordance with our Biometric Information Policy, which generally requires deletion when the original purpose has been satisfied and no later than three (3) years after the individual's last interaction with the Gygler platform, subject to any legal retention obligations.
Your Choices & Rights
You have the right to access and update your profile information through your account settings. Depending on your jurisdiction (such as California), you may have additional rights, including:
- Right to Know: The right to request a copy of the specific pieces of personal information we have collected about you.
- Request Deletion: You can request the deletion of your account and personal data, subject to our data retention policy described above.
- Profile Update / Correction: You may update your profile information, request correction of inaccurate personal information, or adjust notification preferences.
- Right to Limit Use of Sensitive Personal Information: The right to limit our use and disclosure of your sensitive personal information (such as SSN or precise geolocation) to that which is necessary to perform the services expected. We use sensitive personal information only for purposes reasonably necessary to provide the services requested and as permitted by applicable law.
- Opt-Out of Marketing: You can unsubscribe from promotional emails or disable push notifications at any time.
- California Residents' Right to Opt-Out of Sale or Sharing: California residents have the right to direct us not to sell or share their personal information for cross-context behavioral advertising purposes. You may submit an opt-out request by contacting us at questions@gygler.com or by using any available "Do Not Sell or Share" mechanism provided on the Platform.
- To exercise any of your other rights, please contact us at questions@gygler.com. We will not discriminate against you for exercising your privacy rights; however, certain features of the Platform, including personalized advertising or location-based notifications, may not function properly if you opt out of certain data uses.
Children's Privacy
- The Platform is not directed to children under 18. We do not knowingly collect information from individuals under 18.
International Users
- The Platform is intended for users located in the United States. If you access the Platform from outside the U.S., you consent to the transfer of your data to the U.S.
Updates to This Policy
- We may update this Privacy Policy from time to time. We will notify you of changes by posting the updated version on the Platform and updating the "Effective Date."
